The Givinga Foundation, Inc. (“GF”, the “Foundation”, “we”, “us”, or “our”) has prepared this Privacy Policy to describe to you our practices regarding the Personal Information (as defined below) we collect from users of our website, (the “Site”), and online services (“Services”), including our mobile application (“App”). Givinga, Inc. (“Givinga”) provides the technology and administrative platform for GF. GF is a registered, tax-exempt 501(c)(3) public charity, and is the recipient of all donations made through the Site.

By submitting Personal Information through our Site, you agree to the terms of this Privacy Policy and you expressly consent to the collection, use and disclosure of your Personal Information in accordance with this Privacy Policy.

A Note to Users Outside of the United States

If you are a non U.S. user of the Site or Services, by visiting the Site and/or providing us with Personal Information, you acknowledge and agree that your Personal Information may be processed for the purposes identified in the Privacy Policy. In addition, your Personal Information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Information may be less stringent than the laws in your country. By providing your information, you consent to such transfer.


Our Site and Services are not directed to children and children are not eligible to use our Services. Protecting the privacy of children is very important to us. In keeping with the Children’s Online Privacy Protection Act (COPPA), the law that protects children’s online privacy, we limit the collection of Personal Information from children under the age of 18. We do not intentionally collect or maintain Personal Information from people we actually know are under 18 years of age, and no part of our Site or Services is designed to attract people under 18 years of age. If we learn that a user is under 18 years of age, we will take steps to remove that user’s Personal Information from our databases and to prevent the user from utilizing the Site and the Services. Personal Information We Collect

Personal Information: For purposes of this Privacy Policy, Personal Information includes name, email and postal addresses, telephone number, and country of residence, credit card number, billing and financial information.

We collect Personal Information that you submit to us voluntarily when you register to create an account (“Account”) and when you make donations to GF. In both cases you will be asked to complete online forms, which call for you to provide Personal Information as defined above, such as your name, contact details, and certain financial information. In addition, if you provide us feedback or contact us via email, we will collect your email address, as well as any other content included in the email, in order to send a reply.

How We Use Personal Information

We will use your Personal Information to:

● Establish and administer your Account;
● Process your donations;
● Provide you with Services and customer support;
● Tailor the features and content of the Services to you;
● Respond to your requests, resolve disputes and/or troubleshoot problems;
● Regulatory reporting as required by the IRS;
● Verify your compliance with your obligations in our Terms of Use; and
● Communicate with you about the Services.

We may also use your Personal Information to create Anonymous Information records by excluding information that makes the information personally identifiable to you.

We do not share your personal information with third parties other than as follows:

● With charitable recipients, as more fully discussed below;
● With third party vendors, consultants and other service providers who work for us and need access to your Personal Information to do that work;
● With affiliates of GF, such as its parent and subsidiary organizations and organizations with which it enters joint ventures, pursuant to this Privacy Policy;
● With third parties to whom you expressly direct or permit disclosure;
● To comply with laws or to respond to lawful requests and legal process;
● To protect the rights and property of GF, our agents, users, partners, and others, including to enforce our agreements, policies, and Terms of Use;
● To investigate or assist in preventing any violation or potential violation of the law, this Privacy Policy, or our Terms of Use, including as part of credit fraud protection.
● In an emergency to protect the personal safety of GF personnel, users, or any person; or
• In connection with or during negotiation of any merger, financing, acquisition, bankruptcy, dissolution, transaction or proceeding involving sale, transfer, divestiture or disclosure of all or a portion of our assets to another organization.

We may also share aggregated or de-identified information.

How We Share Personal Information with Charitable Recipients

Before you confirm your donation to GF through the Givinga platform, you are asked what information you wish to share with recipient charities. In addition to the amount and date of transactions, you have a choice as to whether to share your name and email address with the charity, or no Personal Information (anonymous). When you opt for anonymity and then recommend a grant, GF does not share your Personal Information with the charity recipient. For any donation for which you do not request anonymity, GF will disclose your name and email address to the applicable charity. You acknowledge that GF has no control over, or responsibility for, such charity’s use of such information.


Anonymous Information We Collect

Anonymous Information: We collect the following types of Anonymous Information:

Information Collected by Our Servers. To make our Site and Services more useful to you, our servers (which are hosted by a third party service provider) collect information including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.

Log Files. As is true of most websites, we gather certain information automatically and store it in log files. This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data.

Cookies. Like many online services, we use cookies to collect information. “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website. We may use both session Cookies (which expire once you close your web browser) and persistent Cookies (which stay on your computer until you delete them) to provide you with a more personal and interactive experience on our Site.

Mobile Device. We may collect information about the computer or device you use to access our Site, including the hardware model, operating system and version, MAC address, unique device identifier, phone number, and mobile network information. In addition, the Site may access your device’s image storage applications, with your consent, to facilitate your use of certain features of the Site. How We Use Anonymous Information

We use the Anonymous Information we collect to analyze trends, administer and improve the Services, track users’ movements in the App, gather demographic information about our user base as a whole, and better tailor our Services to our users’ needs. How We Disclose Anonymous Information

We reserve the right to disclose Anonymous Information publicly without restriction.

Disclosure – Analytics. We may also use third party tracking services to help us analyze how users use the Site. These services collect only the unique device identifier assigned to your mobile device, rather than your name or other personally identifying information, and use it to collect information such as how often users open the App and what features they use in the App. We only use this information to improve our App and Services. We do not combine the information generated thereby with your Personal Information and we do not associate you in any way with your device identifier. Only these services know and associate you (on a non-identifiable basis) with your identifier.

Your Choices Regarding Your Information

Email Communications. We may periodically send you free newsletters and e-mails that directly promote the use of our App or Services. When you receive newsletters or promotional communications from us, you may indicate a preference to stop receiving further communications from us and you will have the opportunity to “opt-out” by following the unsubscribe instructions provided in the email you receive or by contacting us directly. Despite your indicated email preferences, we may send you service-related communications, including notices of any updates to our Terms of Use or Privacy Policy, which you may not opt out of.

Cookies. If you decide at any time that you no longer wish to accept cookies from our Service for any of the purposes described above, then you can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. Consult your browser’s technical information. If you do not accept cookies, however, you may not be able to use all portions of the Service or all functionality of the Service.

Controlling Your Information

You can review and/or change certain portions of your Personal Information by logging into the Site and accessing your Account, or by contacting [email protected]. If you completely delete all of your Personal Information, then your account may become deactivated, although your Profile will remain on the Site unless you have deleted it or requested its deletion. You authorize us to use and disclose any new or modified information that you provide in accordance with this Privacy Policy, and you agree that we are under no obligation to delete or modify information that you have previously chosen to provide us. Any Personal Information or content that you voluntarily disclose in public areas of the Site, such as in the creation of your Profile, becomes publicly available and can be collected and used by others. You should exercise caution before disclosing your Personal Information through these public venues.

Upon your request, we will close your Account. We may retain your Personal Information to comply with laws, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigations, enforce our Terms of Use, and take other actions otherwise permitted by law.

Third Parties

We use third parties to gather end user data from financial institutions. By using our Site, you grant our third-party provider the right, power, and authority to act on your behalf to access and transmit your personal and financial information from the relevant financial institution according to terms of our third-party provider’s privacy policy.

The terms of this Privacy Policy address only GF’s use and disclosure of information we collect from and/or about you on the Site and Services. If you disclose information to others, or authorize us to do the same under this Privacy Policy, the use and disclosure restrictions contained in this Privacy Policy will not apply to any third party. We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

The Site and App may contain content or links to other websites that are not owned or controlled by us. We have no control over, do not review and are not responsible for the privacy policies of or content displayed on such other websites. When you click on such a link, you will leave our Site and go to another site. During this process, another entity may collect Personal Information or Anonymous Information from you. The Site may also contain links to other websites controlled by us but which operate under different privacy policies. Please review the privacy policy of any new website you visit.

Security of Your Personal Information

We are committed to protecting the security of your Personal Information. We use a variety of industry-standard security technologies and procedures to help protect your Personal Information from unauthorized access, use, or disclosure. We also require you to enter a password to access your Account information. Please do not disclose your Account password to unauthorized people. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while GF uses reasonable efforts to protect your personal information, it cannot guarantee its absolute security.

Changes to this Privacy Policy

This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new or revised Privacy Policy here and we will change the “Last Updated” date above. You should consult this Privacy Policy regularly for any changes.
